Terms and Conditions
HOME TLC OBLIGATIONS
1. Home tlc will supply materials and goods of reasonable quality and adequate for the purpose.
2. Home tlc shall provide the services using all reasonable care and skill
3. Home tlc shall inform the client of any necessary changes of services or goods and pricing prior to completion and confirm the same in writing for agreement by the client prior to the work being carried out.
4. Home tlc shall not use any personal information other than in accordance with the Data Protection Act 1998 and other applicable laws
5. All information is given in good faith
6. Home tlc undertakes to make reasonable endeavours in providing advice and encouragement in the de cluttering and organisation process. Ultimately, it is the client’s decision whether to keep items or let them go.
7. Home tlc will carry out work on behalf of the client in accordance with the agreed written terms of work required to be carried out, any variation to the necessary works will only be carried out if such variations and extra cost are confirmed in writing and signed by both Home tlc and the client
DISCLAIMER
8. Home tlc can accept no responsibility for the actions the client takes on the basis of that advice and encouragement, or their consequences, whether this be at any subsequent or future date following engagement or consultation
9. Home tlc is not a valuer of art or any other items of special value or rarity, the client acknowledges on engaging Home tlc that they, the client accept responsibility for either keeping items or letting them go any such items. Clients are advised to seek their own valuations of any items
10. All recommendations given by Home tlc are of aesthetic/cosmetic nature only. Home tlc are not qualified to provide structural recommendations. Such recommendations should be provided by a qualified building surveyor and/or a structural engineer
11. Cellars and loft spaces will not be inspected. Home tlc reserves the right to exclude any other areas which may have limited or unsafe access
12. Before implementing any recommendations given by Home tlc the client should ensure that they are satisfied with the cost effectiveness of these recommendations. The client should take the necessary health and safety precautions prior to taking any recommended work
13. Home tlc does not give any guarantee that the client will find buyers or tenants within a specific time or that the value of the property or rental will increase within a specific limit
CONFIDENTIALITY AND PRIVACY
14 Home tlc is a personal and confidential service. Client’s details will not be disclosed to any third party without the clients consent
15 Any testimonial, comment or photograph provided by clients for publicity material are reproduced with the knowledge of the client concerned
CANCELLATION
Terms of cancellation
16. Up to 48 hours prior to the date of appointment for work to commence – No administration charge
17. Between 48 and 24 hours prior to the appointment date – An administration charge of £50.00 plus any other expenses incurred by the Consultant in excess of £50.00, whichever is the greater.
18. Less than 24 hours prior to the appointment – An administration charge of £80.00 plus any other expenses incurred by the Consultant in excess of £80.00, whichever is the greater.
19. The client may cancel the contract by giving notice in writing to Home tlc and the above cancellation terms apply, if the cancellation notice is given after commencement of work the client will be responsible for the payment of all services and expenses incurred by Home tlc up to that date including any orders paid or part paid for by Home tlc but not at the date of cancellation delivered.
VALIDITY
20. All information, suggestions and recommendations given by Home tlc whether verbally or in writing is only valid for 45 days from the date thereof
21. These terms and conditions will automatically apply when the client orders any services
TIMESCALE
22. Home tlc shall inform the client of the date of commencement of work and an estimated completion date. Any date given is an estimation only. Whilst Home tlc endeavours to complete the services within the estimated date, Home tlc shall not be made liable in any delay in completing these services
CLIENT OBLIGATIONS
23. The client shall give access to the property, at all reasonable times, to help Home tlc or representatives, sub contractors and suppliers for the purpose of supplying services, goods and materials
24. The client shall ensure that all relevant health and safety at home legislation is complied with for the protection of Home tlc, its contractors and suppliers.
25. The client shall ensure that water and electrical supplies are available at the property to carry out services at no extra cost to Home tlc
26. The client is liable for any loss or damage to goods, materials, tools or equipment delivered to or stored at the property belonging to Home tlc unless Home tlc consultants, representatives or suppliers fail to take reasonable care of the same.
27. The client shall ensure to have adequate Home contents insurance to cover all items provided to the client by Home tlc. Any damage of shortage of items must be reported within 48 hours. Home tlc is not liable for any damage or missing items after delivery and installation
THIRD PARTIES
28. The client may use his own contractors and suppliers. Should Home tlc introduce third party suppliers, tradespersons or other specialists to the client, the client will form a direct contract with the third party and be responsible for the contractual relationship and all payments due to the third party
29. If project management is requested by the client, the client shall remain responsible for all financial aspects and full settlement of the costs of services provided
PAYMENT TERMS
30. Home tlc’s restyling, staging and de cluttering and organisational services are payable in 2 instalments: -
1. 50% prior to the commencement of services
2. Balance on completion of the services.
31. Project management services which are over a 3 week period are payable in 3 instalments,
1. 30% on commencement of the project
2. 40% in the middle of the project
3. Balance upon completion.
Payments are due immediately on presentation of invoice.
32. Commencement of any project will only start once payment of the deposit is fully cleared. Cost of supplies, goods and materials bought by Home tlc on behalf of the client are payable in advance prior to the purchase
33. Dependent upon the location of the property and upon agreement with the client, additional travel and accommodation costs may be payable by the client. Daily additional travel costs may be payable by the client for any project lasting 5 days or more. The amount will depend on the location of the property and will be communicated to the client prior to commencement of work
34. Home tlc’s consultation fee is payable immediately at the end of each consultation
35. The client is responsible for the payment of third party suppliers introduced by Home tlc
36. Payment can be made in cash, cheque with supporting card or bank transfer (bank details are provided on request and with the invoice). Cheques are only accepted on the basis of being paid on first presentation. The client will be liable to pay an administration charge of £32 for each cheque returned unpaid whether or not the cheque was honoured upon subsequent presentation
37. Home tlc may charge the client 5% interest rate above the base rate of NatWest Bank plc shall the client fail to settle any outstanding payment. Interest would apply from the date of the invoice up until full settlement is received.
38. Should the need arise for Home tlc to instruct a debt recovery agency or to instigate legal proceedings, the client will be liable for any costs so incurred.
39. Refunds are at the discretion of the management
PUBLIC AND PRODUCT LIABILITY
40. Home tlc is fully insured with the insurance provider Equity for public liability
GENERAL
41. Home tlc shall not be made liable for any failure to provide the service due to unexpected circumstances or circumstances beyond its control
42. Home tlc may use photographs or other types of footage of the property for publicity, advertising or promotional purpose, but the identity of the property owner shall not be revealed unless written consent is given
43. Home tlc will not be liable to the client for any breach of contract arising from or may which have been caused by an act of God, force majeure, war, riot, civil commotion, government orders, direction or legislation by fire, accident, strike, or other industrial action, adverse weather conditions, delays in transport or by any other matter for which Home tlc has no control.
44. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Both the client and Home tlc shall submit any dispute arising hereunder to the exclusive jurisdiction of the courts of England and Wales
